Curacao Dreams Car Rental offers this website including all information and services from us to you, the Renter, conditioned upon your acceptance of all terms, conditions, policies, and notices stated

here.

By visiting our website and/ or renting a vehicle from us, you engage in our “Service” and agree to be bound by the following terms and conditions. If the rental car is driven by a driver other than the Renter, the Driver(s) must be familiar with and comply with these terms and conditions. Please read these terms and conditions carefully.

Definitions

In these terms and conditions, the terms below have the following meaning:

Rental Vehicle: the vehicle or any other item of the property being subject to the rental agreement;

Renter: the natural individual who concluded a rental agreement within the conduct of a profession or business or the legal person/ entity or partnership that concludes the rental agreement as to the Renter;

Curacao Dreams Car Rental: the natural individual, legal person, or partnership that concludes the rental agreement as a representative of the renting party;

Client: the natural individual, who has concluded the rental agreement while not acting in the course of his/her business or profession;

Rental rate/ charge: the amount due to be paid by the Renter to Curacao Dreams Car Rental, including fees for additional services and administration.

Driver: The actual Driver(s) of the vehicle.

Rental agreement: agreement signed between Curacao Dreams Car Rental and the Renter, Driver(s).

2. Making Reservations

Provided that the Renter agrees to the Terms and Conditions and the price list, etc. as set forth separately, the Renter can, upon renting the rental vehicle, by the method provided separately, make reservations by specifying in advance the class of the rental vehicle, the commencement date and time of rental, the renting place, the period of rental, the returning place, the driver’s name(s), use or non-use of a child seat or other accessories, and other rental conditions (hereinafter referred to as “Renting Conditions”).

Upon receipt of the reservation from the Renter, we shall comply, in principle, with such reservation to the extent that the rental vehicle is available for such rental.

3. Change of reservation

If the Renter desires to change any of the renting conditions as described under 2.1, the Renter must obtain our consent in advance.

4. Substitute for the Rental Vehicle

If the Renter is unable to rent a vehicle of the same class reserved by the Renter, we may offer the rental of a vehicle of a different class.

If the Renter accepts the offer in 4.1, the company will rent a substitute vehicle according to the rental conditions presented at the time of If the rental rate of the substitute vehicle is higher than the class of the reserved vehicle, the rental rate of the reserved class will be used; if the rental rate of the replacement vehicle is lower than the class of the reserved vehicle, the rental rate from the exchange vehicle class will be used.

5. Execution of the Rental Agreement

6. Refusal to Execute the Rental Agreement

If the Renter or the Driver(s) has defaulted on the payment of rental charges or other payments owed to the company with respect to past rentals

Where the Renter or Driver(s) damages the company’s credit or interferes with the business of the company by misrepresentation, fraud or violence.

7. Formation of the Rental Agreement, Etc.

12. Exceeding the rental period

13. Cancellations

19. Measures in Case of Non-Return

25. Confiscation and Repossession of the vehicle

The Renter agrees that we do not have to notify him/her in advance of any measures reasonably necessary to obtain possession of the rental, including remote engine disabling, remote door locking, tracking of the location of the car by GPS tracking devices, and apply for our benefit any other device connected to the rental vehicle or interfering with the operation of the rental If the rental vehicle is repossessed, The Renter agrees to pay or reimburse us for our actual and reasonable costs to repossess the car. The Renter agrees that these charges will be billed to the credit or debit card or account used to rent the rental vehicle.

26. Termination of the rental agreement

If during the period of use of the rental vehicle, the Renter or the Driver(s) violate these terms and conditions, Curacao Dreams Car Rental may terminate the rental agreement without notice or reminder and immediately require the Renter or Driver(s) to return the rental vehicle. In such case, the Renter will not be entitled to a refund. The right of termination also applies in the event of Renter’s death, if Renter has been taken into custody, if Renter requests a postponement on payment and if Renter has been declared bankrupt. Curacao Dreams Car Rental also has the right to terminate the Rental Agreement if the Renter moves abroad, in the event of a confiscation of the rental vehicle or if we become aware of circumstances during the rental period of nature such as that Curacao Dreams Car Rental would not have concluded the rental agreement if the company had known about it.

The Renter will compensate Curacao Dreams Car Rental for all damages caused to the company in the case referred to in the aforementioned article.

27. Termination of the Rental Agreement due to Non-Usability of the Rental Vehicle

If the Renter or the Driver(s) cannot continue using the rental vehicle due to breakdown, accident, theft, or any other cause during the period of use of the rental vehicle, the Rental Agreement shall terminate.

If the Breakdown, is caused by defects, flaws, or other non-compliance of the Rental Vehicle with the Renting Conditions existing before its delivery to the Renter, a new Rental Agreement shall be deemed to have been executed, and the Renter may be provided with a Substitute Vehicle from the company.

If the Renter is not provided the Substitute Vehicle under 1, Curacao Dreams Car Rental shall return to the Renter the remaining balance of the rental charge received after deducting the portion of the rental charge which corresponds to the period from the commencement of rental to the termination of the Rental Agreement.

If the Breakdown, etc. is due to causes not attributable to the Renter, or the Driver(s) or Curacao Dreams Car Rental, the company shall return to the Renter the remaining balance of the rental charge received after deducting the portion of the rental charge which corresponds to the period from the commencement of rental to the termination of the Rental Agreement.

Except for the measures set forth in section 27, the Renter shall make no other claims against Curacao Dreams Car Rental with respect to damages or losses arising out of the unavailability of the rental vehicle.

28. Renter’s liability for acts or omissions on the part of third parties

The Renter is responsible for acts or omissions of the authorized Driver(s), passengers, and any other user of the rental vehicle, even if they acted without the Renter’s permission.

29. Unavoidable Casualty

If Curacao Dreams Car Rental is unable to fully or partially fulfill its obligation due to unavoidable casualty, it has the right to suspend or terminate the Rental Agreement in whole or in part, without judicial intervention, without the right to any compensation. In such a case, the Renter will be granted a refund on a prorated basis.

By unavoidable casualty we mean: strikes, lockdowns, fires, mechanical failures and other business disruptions at Curacao Dreams Car Rental contractor or its suppliers of goods and services, transportation disruptions, and other extraordinary events or circumstances beyond our control of parties such as wars, blockades, riots, epidemics, devaluation, floods, and storms, as well as a sudden increase in import duties, taxes and duties, delays in delivery by suppliers, failure to obtain necessary permits and other government measures.

30. Renter’s liability

If during the performance of the rental agreement signed between Curacao Dreams Car Rental and the Renter circumstances occur (such as negligence on the part of Curacao Dreams Car Rental) which result in a liability on the part of the company, this liability is limited to the amount (s) that Curacao Dreams Car Rental has agreed to its insurer. Curacao Dreams Car Rental is not obliged to pay any further compensation.

31. Indemnification

The Renter is solely responsible for their use of the website. The Renter hereby indemnify, defend, and hold harmless; Curacao Dreams Car Rental and the providers, its and their officers, directors, employees, service providers, vendors, affiliates, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation by the Renter or Driver(s) of these terms.

32. Purpose of Use of Personal Information

Personal data of the rental agreement is registered in the administration of Curacao Dreams Car Rental. With this registration, the company can implement the rental and provide the Renter or the authorized Driver(s) optimal service

and current product information. This information can also be used to make the Renter or the authorized Driver(s) special offers. The Renter or the authorized Driver(s) can object to Curacao Dreams Car Rental using their personal information for direct mailings that we will honor.

Curacao Dreams Car Rental obtains and makes use of personal information of the Renter or the Driver(s) for the following purposes.

For the purpose of providing the information required by law as a condition of the business permit, including but not limited to the preparation of the car rental certificate at the time of the execution of the Rental Agreement.
To present rental vehicles, and other products offered by Curacao Dreams Car Rental, provide related services, etc. and notify the progress of various events, campaigns, through methods such as sending promotional material, e- mails, etc. to the Renter or the Driver(s).
To verify the identification or screening of the Renter or the Driver(s) upon the execution of the Rental
To conduct a survey campaign aimed at the Renter or Driver(s) to plan and develop new products and services offered by the company or study ways to improve customer satisfaction.
Collecting and statistical analysis of personal information and creating a statistical database in a form that cannot be recognized or displayed by natural persons.

32.1 If Curacao Dreams Car Rental intends to collect personal information from the Renter or Driver(s) for a purpose not specified in each paragraph, the specific purpose is established in advance.

33. Track & Trace via GPS

Curacao Dreams Car Rental uses GPS tracking devices to track or locate vehicles that are overdue, reported stolen or suspected of being lost or abandoned as may be required or requested by law enforcement or to identify rental vehicles that have been damaged and may require roadside assistance, when we believe in good faith that there is an emergency that threatens your safety or the safety of another person, or as necessary to defend, protect or enforce our rights in connection with the use of our products and/or services. You should not expect any privacy or confidentiality as to where the rental vehicle is driven while it is being rented.

34. Reference Check

Curacao Dreams Car Rental reserves the right to conduct checkups on the rental vehicles.

35. Applicable law

All agreements between Curacao Dreams Car Rental and the Renter and the present general terms & conditions will at all times be governed by Dutch Antillean law. All disputes resulting from and are agreed in these Terms and Conditions and those resulting thereafter will be judged at the ‘Gerecht in Eerste Aanleg van de Nederlandse Antillen’, seated in Curacao.

These Terms and Conditions are also applicable to supplementary Rental Agreements between Curacao Dreams Car Rental and the Renter as well as the existing Rental Agreement.

36. Changes in Terms and Conditions

Curacao Dreams Car Rental reserve the right, at our sole discretion, to update, change or replace any part of these terms and conditions. It is your responsibility to check our website periodically for changes. You can review the most current version at any time on this page.
